Acceptable Use Policy

1. Introduction
This Acceptable Use Policy ("AUP") governs access to and use of the Chissa platform, operated by Chissa Media (Pty) Ltd, a company registered in the Republic of South Africa ("Chissa", "we", "us", or "our"). The platform is accessible at www.chissa.co.za and through associated mobile applications.
Chissa is a creator-fan community platform designed to facilitate direct, subscription-based relationships between creators and their fans. It is not a general-purpose streaming service. The platform exists to support authentic African creative voices and to provide meaningful, recurring income for creators through deep community engagement.
By accessing or using Chissa in any capacity - whether as a fan, creator, or visitor - you agree to comply with this AUP in full. This AUP forms part of and is incorporated into Chissa's Terms of Service. In the event of any conflict between this AUP and the Terms of Service, this AUP prevails in respect of conduct and content obligations.
2. Definitions
In this AUP, the following terms have the meanings set out below:
- Platform: the Chissa website at www.chissa.co.za, mobile applications, APIs, and all associated services operated by Chissa Media (Pty) Ltd.
- Creator: a South African registered user who publishes content on the Platform and has completed creator onboarding, including KYC verification.
- Fan: a registered user who subscribes to a Creator's fan tier to access exclusive content and community spaces.
- Subscription: a recurring monthly payment of R99 made by a Fan to access a specific Creator's fan tier on the Platform.
- Content: any material a user uploads, posts, streams, transmits, or otherwise makes available on the Platform, including video, audio, images, text, and live streams.
- Creator Space: the private community environment associated with a Creator's fan tier, accessible only to that Creator's active Fans.
- Short: short-form video content made publicly available by Creators for discovery purposes, accessible without a subscription or login.
- POPIA: the Protection of Personal Information Act 4 of 2013 (South Africa).
- FPB: the Films and Publications Board, established under the Films and Publications Act 65 of 1996 (South Africa).
3. Platform Model and Scope
Chissa operates a single-tier creator subscription model. Creator onboarding is currently available only to Creators resident in, operating from, and eligible to receive payouts in South Africa. Each approved Creator offers one fan tier at a fixed monthly subscription of R99 per month. There is no platform-wide subscription. Chissa Media (Pty) Ltd acts as the merchant of record for all transactions; Fans pay Chissa, and Chissa distributes creator earnings in accordance with the Creator Agreement.
Creators are independent contractors, not employees of Chissa. This AUP applies equally to all users regardless of account type, but Creator-specific Platform features are limited to approved South African Creators for now.
4. Permitted Use
4.1 Creators
Creators may use the Platform to:
- Publish original video, audio, and written content within their Creator Space.
- Broadcast live streams to their subscribed Fans.
- Publish publicly accessible Shorts for content discovery.
- Engage directly with Fans through community posts, comments, and live chat.
- Access earnings data, audience insights, and subscription analytics through the Creator Dashboard.
4.2 Fans
Fans may use the Platform to:
- Subscribe to one or more Creator tiers at R99 per Creator per month.
- Access exclusive content, community spaces, and live streams of subscribed Creators.
- Engage with Creators and other Fans through comments and community interactions within a Creator Space.
- View publicly accessible Shorts without a subscription or login.
5. Prohibited Conduct
The following conduct is strictly prohibited on the Platform. Violation of any provision in this section may result in immediate account suspension or termination, content removal, reporting to law enforcement, and recovery of any losses suffered by Chissa.
5.1 Illegal Content
Users must not upload, publish, transmit, or facilitate:
- Content that is unlawful under South African law or any applicable jurisdiction.
- Child sexual abuse material (CSAM) or any content that sexualises, exploits, or endangers minors in any manner whatsoever. Chissa will report all such content to the South African Police Service and the FPB without delay.
- Content that facilitates or incites terrorism, political violence, or armed insurrection.
- Content that constitutes fraud, money laundering, or any other financial crime.
- Pirated, counterfeit, or unauthorised reproductions of third-party intellectual property.
5.2 Harmful and Hateful Content
Users must not publish or transmit content that:
- Constitutes hate speech as defined under the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (PEPUDA), including content that demeans or dehumanises any person on the basis of race, ethnicity, gender, sexual orientation, religion, disability, or any other protected ground.
- Incites violence or harassment against any individual, community, or group.
- Targets or marginalises any of South Africa's official language communities or cultural identities.
- Promotes tribalism, xenophobia, or inter-community hostility.
- Constitutes or facilitates cyber-bullying, stalking, or targeted harassment of any user or individual.
5.3 Adult and Explicit Content
The Platform does not permit:
- Sexually explicit or pornographic content of any kind.
- Content depicting nudity in a non-consensual or exploitative context.
- Content that depicts or glorifies graphic violence, torture, or bodily harm.
Content that may be considered adult in nature (including mature themes, coarse language, or age-restricted material) must be disclosed by the Creator during upload or prior to going live. Chissa reserves the right to require age verification or to restrict access to any content it determines to be unsuitable for a general audience.
5.4 Films and Publications Board (FPB) Compliance
Content published on the Platform may be subject to the Films and Publications Act 65 of 1996 and its amendments. Creators are responsible for ensuring their content complies with any applicable FPB classification or distribution requirements. Chissa will report prohibited content categories to the FPB or other authorities where required by law.
5.5 Misinformation and Manipulation
Users must not:
- Publish or distribute demonstrably false information that is likely to cause harm, panic, or public disorder.
- Use the Platform to conduct coordinated inauthentic behaviour, including the artificial inflation of engagement metrics, follower counts, or subscription numbers.
- Impersonate any individual, organisation, or official body, including other Chissa users or Chissa staff.
5.6 Platform Integrity
Users must not:
- Attempt to circumvent, disable, or interfere with any technical or security feature of the Platform.
- Use automated tools, bots, scrapers, or scripts to access or interact with the Platform without Chissa's prior written consent.
- Probe, scan, or test the vulnerability of any Chissa system or network.
- Introduce malware, ransomware, spyware, or any other malicious code.
- Attempt to access accounts, data, or systems not belonging to them.
5.7 Payment and Commercial Misconduct
Users must not:
- Initiate fraudulent chargebacks or make false payment dispute claims.
- Attempt to circumvent the Platform's subscription model to access paid content without a valid subscription.
- Use the Platform to solicit direct payments from Fans outside of the Platform's billing system, whether in fiat currency or cryptocurrency.
- Promote pyramid schemes, multi-level marketing, or fraudulent investment opportunities.
6. Creator-Specific Obligations
In addition to the general conduct obligations above, Creators accept the following specific obligations as a condition of their creator account and revenue-sharing arrangement:
- Creators are solely responsible for ensuring that all content they publish complies with this AUP, South African law, and any applicable third-party rights including copyright, trademark, and personality rights.
- Creators must not publish content that is designed primarily to harvest personal information from Fans, including phishing attempts, fake surveys, or deceptive call-to-action schemes.
- Creators must maintain the confidentiality of their authentication credentials and are responsible for all activity conducted under their account.
- Creators must not assign, sublicense, or transfer access to their Creator Space or Dashboard to any third party without Chissa's written consent.
- Creators who publish live streams must ensure that third-party participants in those streams are aware they are being broadcast.
- Creators must promptly comply with any content moderation notice or takedown request issued by Chissa.
7. Privacy and Data Protection
Chissa processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Users must not use the Platform to collect, process, or transmit the personal information of other users except as expressly permitted by the Platform's features and in compliance with POPIA.
Screen-recording, unauthorised sharing, or republication of content from within a private Creator Space - including live streams, chat messages, and community posts - without the express consent of the relevant Creator is prohibited and may constitute a breach of POPIA, copyright law, and this AUP.
8. Intellectual Property
Creators retain all intellectual property rights in the original content they publish on the Platform. By publishing content, Creators grant Chissa a limited, non-exclusive, royalty-free licence to host, display, transcode, and distribute that content to authorised Fans through the Platform, for the duration of the Creator's active account.
Users must not upload, stream, or otherwise publish content that infringes the intellectual property rights of any third party. Chissa will respond to valid takedown notices in accordance with its Copyright Infringement Policy and South African copyright law.
9. Enforcement
9.1 Moderation
Chissa uses a combination of automated moderation tools and human review to identify and address breaches of this AUP. Automated screening is applied to content uploads and live stream activity. Users may also report content or conduct that they believe violates this AUP using the in-platform reporting tools.
9.2 Consequences of Violation
Depending on the nature and severity of a breach, Chissa may take one or more of the following actions:
- Issue a formal warning to the user.
- Remove or restrict access to specific content.
- Temporarily suspend the user's account.
- Permanently terminate the user's account.
- Withhold or reverse any pending creator earnings in cases of payment fraud or platform abuse.
- Report the conduct to relevant authorities, including the South African Police Service, the FPB, or the Financial Intelligence Centre.
9.3 Appeals
Users who believe a moderation action has been applied in error may submit an appeal to support@chissa.co.za within 14 days of the action. Chissa will review the appeal and provide a written response within 10 business days. Submitting an appeal does not suspend the original moderation action pending review.
10. Reporting Violations
If you encounter content or conduct on the Platform that you believe violates this AUP, please report it through one of the following channels:
- In-platform: use the Report button on any content item, comment, or user profile.
- Email: support@chissa.co.za
- Disputes: disputes@chissa.co.za (for payment and commercial disputes)
Chissa will acknowledge all reports within 2 business days and action material violations within 72 hours of confirmation.
11. Amendments
Chissa reserves the right to amend this AUP at any time. Where a change materially affects user rights or obligations, Chissa will provide not less than 14 days' notice by email to registered users and by posting a notice on the Platform. Continued use of the Platform after the effective date of an amendment constitutes acceptance of the revised AUP.
12. Governing Law and Jurisdiction
This AUP is governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with this AUP shall be subject to the exclusive jurisdiction of the courts of South Africa.
